Our pen pal, infamous prisoner Jonathan Lee Riches ©, has written Trumbull once again. This time he wishes to update us on his current and unprecedented situation. With the passage of the USA PATRIOT Act, Americans have seen a steady decline in their civil liberties. And now it appears that another constitutional protection has fallen by the wayside for one individual (download the case here). So without further ado, Mr. Riches, the floor is yours…

Dear Trumbull,

The Bureau of Prisons in conjunction with the Federal Medical Center, Lexington Kentucky, (FMC Lexington) are going through extraordinary means to silence me, punishment through solitary confinement with psychological warfare inflicted on my life.

I’ve already been in solitary for 8 months, and their plan is for me to remain in solitary until my release date (March 25, 2012). By then, I would of spent 2 years in solitary, I’m being held for non disciplinary reasons. I’m detained for practicing my 1st amendment rights for freedom of speech, and accessing the courts. I’m also being persecuted for whistle blowing government and employee misconduct / corruption at the federal medical center in Lexington Kentucky. For retaliation, the FMC Lexington administration wants to discredit me and keep me isolated to prevent me from speaking out against crimes they committed, and atrocities FMC Lexington employees committed on me and others, along with exposing sexual abuse in RDAP, residential drug abuse program held at FMC Lexington. On 9-14-10, I was sued by the United States of America with a preliminary injunction, preventing me from filing and / or sending out any more lawsuits via the mail while I’m at FMC Lexington, and giving FMC Lexington authorities and administration authorization to open up all my sealed legal mail, and screen it where if “they” feel its frivolous or without merit, they have permission to send my legal mail back to me without sending it out. This injunction is a violation of my constitutional rights to access the courts. This gives the Bureau of Prisons, FMC Lexington, a blank check to abuse and torture at will, and at any time.

For example, from now on, since this injunction is in place, a BOP employee at FMC Lexington could rape, abuse, torture, discriminate, and / or violate my civil rights and if I file a lawsuit to report it, the lawsuit will never get sent out in the mail, as FMC Lexington will screen it, and send it back to me. This puts me in imminent danger and bodily harm. FMC Lexington Administration are livid and angry that I exposed and sued numerous FMC Lexington staff in Federal courts.

FMC Lexington deals with the burden of continuous requests from media, news reporters, bloggers, fans, stalkers, etc. contacting the prison daily to inquire about me. Further, read the opinion and order by Judge Forrester on my preliminary injunction, which states the injunction is to remain in effect as long as I’m confined in the Eastern District of Kentucky. Now, FMC Lexington refuses to transfer me to another prison because the administration claims if transferred, the next prison would have to do all the paperwork over again, and that prison not being familiar with the injunction which would enable me to file more lawsuits.

I’m also being discriminated with attorney-client confidentiality as the injunction only gives FMC Lexington authorization to open all legal mail addressed to the courts, but FMC Lexington is taking the initiative to circumvent this order by opening up all my sealed outgoing legal mail to attorneys, which is also violating my constitutional rights. I will continue to keep you all informed on my status and any new developments. At this time, I fully expect and I’m prepared to remain in solitary to I go home. If something does happen to my health, safety, and well being. FMC Lexington is responsible and demand them to be held accountable for their actions.
